TERMS OF USE
This Terms of Use agreement (“Terms”) is a legally binding document between you (“User” / “You”) and Bhatia Indian Garments, the sole proprietorship firm operating the brand Laavan Phere (“Company” / “We” / “Us” / “Our”), with its principal place of business at 302, Sri Sai Ashirwad Apartment, Double Transformer Chowk, New Morabadi Area, Morabadi, Ranchi – 834008, Jharkhand, India (GST No.: 20DUHPB1887A1Z8).
These Terms govern your access to and use of our website located at laavanphere.co.in, any associated mobile site, and all related services, content, and products offered through these platforms (collectively, the 201cPlatform201d or 201cServices201d).
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE PLATFORM. By accessing or using the Platform in any manner, you confirm that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy. If you do not agree, please do not use the Platform.
1. Eligibility
By using this Platform, you represent and warrant that:
• You are at least 18 years of age, or have obtained valid parental or guardian consent to use the Platform and enter into these Terms on your behalf.
• You are legally capable of entering into a binding contract under applicable Indian law.
• Your use of the Platform does not violate any applicable law, regulation, or order.
We reserve the right to refuse, suspend, or terminate your access to the Platform if we determine, at our sole discretion, that you do not meet the eligibility requirements set out above.
2. User Account and Registration
Certain features of the Platform may require you to register for an account. When registering, you agree to provide accurate, complete, and current information. You are solely responsible for:
• Maintaining the confidentiality of your account credentials (username and password).
• All activities that occur under your account, whether or not authorised by you.
• Immediately notifying us of any unauthorised use of your account or any security breach at care@laavanphere.co.in.
We are not responsible for any loss or damage arising from your failure to maintain the security of your account. Your account is personal and non-transferable. Sharing account credentials with third parties is strictly prohibited.
3. Products and Pricing
Laavan Phere offers men's ethnic wear products including, but not limited to, kurta-pajama sets, sherwani combinations, and accessory items, under its curated collections.
Product Descriptions: We endeavour to describe and display our products accurately on the Platform. However, minor variations in colour, texture, or embroidery appearance may occur due to differences in display settings, photography conditions, and the inherent nature of handcrafted and artisanal textile work. Such variations do not constitute a defect.
Pricing: All prices listed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without prior notice. We reserve the right to correct any typographical or pricing errors at any time, including after an order has been placed. In the event of a pricing error, we will notify you and give you the option to confirm the order at the correct price or cancel it for a full refund.
4. Orders and Payment
Placing an Order: By placing an order on the Platform, you make an offer to purchase the selected product(s) at the listed price and quantity. Your order is confirmed only when you receive an order confirmation email or SMS from us. We reserve the right to refuse or cancel any order at our discretion, including due to pricing errors, stock unavailability, or suspected fraud.
Payment Modes: We currently accept the following payment methods:
• Credit Cards: Visa, MasterCard, American Express (domestic)
• Debit Cards: All major Indian bank debit cards
• UPI (Unified Payments Interface)
• Net Banking
• Digital Wallets and Cash Cards
• Cash on Delivery (COD) — available at select pin codes within India, subject to order value limits
All online transactions are processed through secure, encrypted payment gateways. We do not store your card or banking credentials on our servers.
Order Cancellation by User: Orders may be cancelled before dispatch. Once dispatched, cancellations are not accepted; you may initiate a return or exchange as per our Return & Exchange Policy.
5. Shipping and Delivery
We deliver across India to serviceable pin codes via our logistics partners. Processing and dispatch of orders typically takes 2–5 business days from the date of order confirmation, subject to product availability and payment verification.
Estimated delivery timelines will be communicated at checkout and may vary based on your delivery location, courier partner capacity, and unforeseen circumstances (including public holidays, natural events, or logistical disruptions).
We currently ship within India only. International shipping is not available at this time.
Laavan Phere is not responsible for delays caused by third-party logistics providers, incorrect shipping addresses provided by the User, or events beyond our reasonable control.
6. Returns, Exchanges & Refunds
Our return and exchange policy forms a part of these Terms and is detailed in our standalone Return, Exchange & Refund Policy available on the Platform. Key highlights:
• Returns and exchanges must be initiated within 7 days of delivery.
• Products must be unused, unwashed, and returned in their original packaging with all tags intact.
• Items purchased during sale events or with promotional codes may be subject to different return conditions, as specified at the time of purchase.
• COD orders are eligible for exchange or store credit only, not monetary refunds.
In the event of a defective or incorrect product being delivered, please contact us at care@laavanphere.co.in or 9102005990 within 48 hours of delivery with photographic evidence. We will arrange for a replacement or full refund at no additional cost to you.
7. Intellectual Property Rights
All content on the Platform — including but not limited to the brand name “Laavan Phere,” the Laavan Phere logo, product photography, design elements, copy, graphics, and other materials — is the exclusive intellectual property of Bhatia Indian Garments and is protected under applicable Indian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for personal, non-commercial purposes. This licence does not permit you to:
• Reproduce, copy, modify, or distribute any content from the Platform without our prior written consent.
• Use our brand name, logo, or product imagery for any commercial purpose.
• Systematically download or scrape content from the Platform to create a database or for competitive intelligence.
Any unauthorised use of our intellectual property will be treated as infringement and may result in legal action.
8. Prohibited Conduct
You agree not to use the Platform to:
• Submit false or misleading information, including fraudulent orders or payment details.
• Attempt to gain unauthorised access to our systems, servers, or data.
• Introduce viruses, malware, or any other harmful code.
• Engage in any conduct that disrupts, overloads, or impairs the Platform's infrastructure.
• Use the Platform in any way that violates applicable law or infringes the rights of third parties.
We reserve the right to suspend or permanently terminate your account and access to the Platform for any violation of these Terms, without prior notice.
9. Privacy Policy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal data. By agreeing to these Terms, you also accept the terms of our Privacy Policy. Please review it carefully.
While we implement commercially reasonable security measures to protect your personal data, we cannot guarantee absolute security against all forms of cyber threats (including hacking or DDoS attacks). By using the Platform, you acknowledge and accept this inherent limitation of internet-based services.
10. Third-Party Links and Services
The Platform may contain links to third-party websites or services (such as payment gateways, social media platforms, or logistics partners). We do not control, endorse, or take responsibility for the content, privacy practices, or availability of those external sites. Accessing third-party links is entirely at your own risk.
11. Disclaimer of Warranties
The Platform and all Services are provided on an "as is" and "as available" basis without any warranty of any kind, express or implied. We do not warrant that:
• The Platform will be uninterrupted, error-free, or free from viruses or other harmful components.
• The information on the Platform is always accurate, complete, or current.
• Products will meet your specific requirements or expectations beyond what is described on the Platform.
To the maximum extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Bhatia Indian Garments (Laavan Phere) shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, profits, goodwill, or business opportunities, arising out of your use of or inability to use the Platform or Services.
Our total aggregate liability to you for any direct damages shall not exceed the amount actually paid by you for the specific product(s) giving rise to the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless Bhatia Indian Garments, its proprietor, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
• Your access to or use of the Platform.
• Your violation of these Terms or any applicable law or regulation.
• Your infringement of any third-party rights, including intellectual property rights.
14. Force Majeure
We shall not be held liable for any delay or failure to perform our obligations under these Terms where such delay or failure is caused by circumstances beyond our reasonable control. This includes, but is not limited to: natural disasters, floods, earthquakes, fires, epidemics, pandemics, acts of government, war, civil unrest, labour disputes, power failures, or disruptions to logistics and courier networks.
In such events, our obligations shall be suspended for the duration of the force majeure event, and we will make reasonable efforts to resume normal operations as soon as practicable.
15. Modifications to Terms
We reserve the right to modify, update, or revise these Terms at any time without prior notice. The revised Terms will be posted on the Platform with an updated effective date. Your continued use of the Platform after any such modification constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
16. Termination
We may, at our sole discretion, suspend or terminate your access to the Platform at any time for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification clauses) shall continue to apply.
17. Grievance Redressal
In compliance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, we have designated the following as our Grievance Officer:

Grievance Redressal Process:
• Step 1 — Customer Care: Contact us at care@laavanphere.co.in or call +91 9102005990. We will acknowledge your complaint within 48 hours and aim to resolve it within 4 working days.
• Step 2 — Escalation: If your complaint is unresolved within 4 working days, escalate by rewriting to care@laavanphere.co.in with the subject line "ESCALATION" and your original ticket number. We will respond within 3 working days.
• Step 3 — Grievance Officer: If still unresolved, contact the Grievance Officer directly at the address or email above. The Grievance Officer will respond within 15 working days.
We shall endeavour to resolve all complaints within 30 days of receipt.
18. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms, including disputes relating to their validity, breach, termination, or the Services provided under them, shall first be attempted to be resolved amicably between the parties within 15 days of written notice of the dispute.
If the dispute is not resolved amicably within the said period, it shall be referred to and finally resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996 (as amended). The seat and venue of arbitration shall be Ranchi, Jharkhand, India. The arbitration shall be conducted in English. The decision of the arbitrator shall be final and binding on the parties.
Subject to the above arbitration clause, the courts at Ranchi, Jharkhand shall have exclusive jurisdiction over any legal proceedings arising out of or relating to these Terms.
19. Statute of Limitations
Any claim or cause of action arising out of or related to your use of the Platform or these Terms must be filed within one (1) year from the date such claim or cause of action arose, or shall be forever barred, to the extent permitted by applicable law.
20. Entire Agreement
These Terms, together with our Privacy Policy and Return & Exchange Policy, constitute the entire agreement between you and Bhatia Indian Garments (Laavan Phere) with respect to the subject matter hereof, and supersede all prior or contemporaneous representations, understandings, or agreements, whether written or oral.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to do so in the future.
